Interestingly enough I read an article earlier this week about BoA doing the same thing to others who thought they were good to go on their loan modification. Gail's situation is especially onerous due to her husbands failing health. I hope BoA wakes up soon as their reputation for doing the right thing is falling well short of the mark.

BOA SENT ME A DECLINE LETTER TODAY AS MY HUSBAND WAS BEING ADMITTED INTO HOSPICE

I made all the trial loan modification payments on time over the phone via my BOA Customer Relationship Manager, yet today I received a FedEx letter stating that my permanent loan modification was DECLINED. At the same time as the letter arrived, the hospice nurse came to sign my husband up for in-home hospice care. Can you believe this????

The letter from BOA states "Thank you for contacting us regarding the Home Affordable Modification Program. While we realize this decision comes at a difficult time in your life, we regret to inform you that we are no longer considering your request for a modification because after being offered a Trial Period Plan, you did not make the required Trial Period Plan payment by the end of the first month of the trial period."

I made the first trial payment on 3/4/13, the second one on 4/2/13, and the third one on 5/2/13. The original letter from my BOA Customer Relationship Manager outlining the terms for the trial period dated 2/25/13 stated, "To participate in the Trial Period Plan, make your first month's trial period mortgage payment as soon as possible, but in no event later than 30 calendar day after 4/1/2013."

Since I made the first payment on 3/4/13 and it was not due until 4/1/13, it seems to me that I am in compliance.

This was so upsetting that I could not focus properly on getting my husband admitted into hospice. My husband is very upset. He has Stage IV, Pancreatic Cancer and was diagnosed 4 years and 4 months ago. He's now in the end stages of the illness.

Can you see where I made an error? Perhaps I'm not thinking straight due to the stress of putting my husband in hospice today. It's an emotional day.

Why wouldn't my BOA Customer Relationship Manager call me to tell me ahead of time that this letter was going out? Why won't she return my calls. I have had to ask for an Appeal, but this is the last thing I need to focus on right now. My attention should be 100% on my husband in his final days.

BOA have a heart!!!!

Run For The Wall organization recognizes the sacrifices and contributions made by all veterans who have served our nation. Veterans of recent conflicts and those currently on active duty are especially welcome to join us as they ride for those who cannot.

Hundreds of veterans and military supporters have arrived in Rancho Cucamonga for the 25th annual Run for the Wall motorcycle ride to Washington D.C. in honor and remembrance of military prisoners of war and those missing and killed in action.

The run is to raise public awareness toward helping pushing the government to locate, identify and relocate the bodies of service members killed in action and still unaccounted for in places like Vietnam and Korea, organizers said.

Registration for the event is in the parking lot of the Hilton Garden Inn and will meet up at the JCPenney parking lot at Victoria Gardens on Wednesday morning for a dramatic departure at approx. 8:00 am.

The 10-day ride is a dramatic sight for anyone coming upon the motorcade. Two groups of about 500 to 600 riders start off on either route that will travel through the southern and central states. From end to end, each rider motorcade can be up to 5 miles long. There are two routes east, both beginning from Rancho Cucamonga, with about 30 riders to a "platoon" and about a 150 feet gap between platoons.

Both groups will unite as one in Virginia and arrive in Washington D.C. on Friday, May 24. A portion will be able to attend a ceremony at the ‘Tomb of the Unknown Soldier’ on May 25. The riders will also gather together at the Lincoln Memorial and walk to the Vietnam Veterans Memorial Wall.

The ride honors American military prisoners of war, and those killed and missing in action during war. Many who ride are Vietnam veterans. The event was started by Vietnam veterans to honor service members in that conflict, but today, the event honors military members from all conflicts. Participants have also served in Korea, Iraq, Afghanistan and others are active duty personnel, friends and family members.

Between the Korean, Vietnam and WWII Wars, there are still approximately 84,000 MIA’s. Awareness may keep the government searching for the MIA’s to bring them home and give them a proper burial.

Military Spouse Appreciation Day-Thank You For Keeping The Home Fires Burning

Did you know that in 1984 President Reagan proclaimed the Friday before Mother's Day of each year to be Military Spouse Appreciation Day? The purpose of this special day is to thank military spouses for the support they give to their family and other military families, to honor their contributions to the communities where they live and to acknowledge the sacrifices they make every day in support of their military member and our country.

Since the day doesn't have a rack of Hallmark cards it may be overlooked by many as a day to honor the sacrifices that military spouses make taking care of home and family while their loved ones are deployed overseas.

If you know a family where the spouse is deployed this would be a great weekend to lend a hand and volunteer to do a simple everyday task. How about offering to mow the lawn, trim the bushes or wash the car. You wouldn't believe how much the simple helping hands are appreciated. If you live in an area with a military base nearby think about taking a moment to say "thank-you" to the military families that you know today.

Remember that there are thousands of men and women who sacrifice for our country without ever being deployed. They are watching their children, moving at a moments notice, and supporting a spouse in harms way without asking for much in return and they deserve our thanks for what they do.

Cook Inlet A Fort Belvoir Address But It's Not Post Housing

When most people think of a Fort Belvoir address they immediately think of the U.S. Army Post. However Cook Inlet shares the Fort Belvoir postal address with its close neighbor but it is not part of the Army Post.

About The Cook Inlet Neighorhood

The first issue to clear up about the neighborhood is the name. Though the official Fairfax County tax records show the name of the subdivision as Cook Inlet the neighborhood is also advertised as Inlet Cove and the entrance sign coming in the community says Inlet Cove. Talk about confusing. If you want to search for the neighborhood you should use the Cook Inlet name in order to find available listings. The neighborhood consists of approximately 255 townhouses and zero lot line detached homes.

Location

Cook Inlet is located one mile from the main gate of Fort Belvoir off or US Route 1. It is less than 3 miles to Lorton town center with access to the VRE commuter line and about 2 miles to the entrance of I-95 for driving access to DC to the north or Quantico and Fredericksburg to the south.

Community Amenities

The neighborhood offers residents a community club house with swimming pool and activity room. There is also a sand volleyball court and tot lot within the neighborhood. The HOA is active in the community with a variety of sponsored get-togethers throughout the year.

With the main gate to Fort Belvoir just a stones throw away military and retirees will be able to easily access the Fort Belvoir Community hospital, the PX and Commissary. Tell a Veteran to Miss a Payment to Qualify for a Short Sale and You May be Up Against the CFPB

Very important information. I had a lender tell an active duty military to miss two payments before they would consider their short sale. It was the "investors" policy. Needless to say we pushed back hard and having this information is very helpful to pass along to a negotiator.

Statistically, over half of the Consumer Finance Protection Bureau (CFPB) complaints to the Office of Servicemember Affairs (OSA) have to do with mortgages. Of these, 58 percent of them had to do with loan modification, mortgage collection practices or foreclosure . . . and yes . . . short sales would fall under this category. While this is a broad range of complaints, I’d like to focus on servicemembers with Permanent Change of Station (PCS) orders and how they relate to short sales.

For Realtors processing short sales on behalf of servicemembers, they’ll want to know that the CFPB is particularly interested in loan servicers:

Failing to provide servicemembers with PCS orders who notify their servicers of such orders with accurate, clear, and readily understandable information about available assistance options for which the homeowner may qualify based on the information known to the mortgage servicer;

Asking servicemembers with PCS orders to waive their legal rights under the Servicemembers Civil Relief Act or any other law as a prerequisite to the mortgage servicer either providing information about available options or evaluating the servicemember’s eligibility for assistance;

Advising homeowners with PCS orders who are current on their loans and able to make the monthly payment to intentionally skip making payments in order to create the appearance they are having financial difficulties in order to obtain assistance for which they would not otherwise qualify;

Failing to provide a reasonable means for servicemembers to find out information about the status of their request for assistance;

Failing to timely communicate the servicer’s decision regarding requests for assistance from homeowners with PCS orders and failing to include and explanation for the denial, where required.

While all 5 of these bullet points are useful in applying pressure to loan servicers who deserve it, it’s bullet point 3 that is of particular interest. This is because while most loan servicers can’t force someone to be late in order to qualify for a short sale due to the Imminent Danger of Default rule, some persist in doing so and their internal policies now run afoul of the CFPB. When this happens, giving up is no longer a suitable option. You now have a friend in Holly Petraeus (yes, that Petraeus) at the CFBP.

To engage the OSA and CFPB in this type of a problem simply submit the complaint and it will follow this process:

I can attest from personal experience that they are very fast and get results quickly (just ask the office of the president of B of A). J Ensuring that things work out this way for servicemembers is essential for them because their PCS orders are binding and enforceable under short timeframes. Ensuring that their short sale happens without them having a late payment on their mortgage is critical because, if it happens that way, they can buy immediately in their new location using VA or FHA financing and they sure deserve to be able to!

Woodbridge VA New Homes Are Selling And Prices Are Rising

Our team makes regular stops at new home sites throughout the Woodbridge VA area to help give our buyer clients the latest in choices for their new homes. Recently I stopped in at Mason's Landing just off Hoadley Road to get an update. My clients were one of the early purchasers in the neighborhood and they were lucky.

Since they signed their contract the base price of the model they bought has gone up $30,000. In addition the incentives the builder is offering has changed. No longer a free finished basement and less in closing cost assistance. They purchased the largest model in the neighborhood with loads of upgrades for a cost of $500,000. Today priced with the same features the home would be $540,000. This is the same scenario we are seeing at multiple sites in Woodbridge.

Schools Matter to Northern Virginia Home Buyers

It's easy to drive through the southern end of Fairfax County and the Mason Neck area see why so many owners are proud to call it home. First there is the history.
